TATI INC (“We”, “Us”, “Our”) delivers promotions, special offers and event alerts to your mobile phone by EMAIL, SMS and/or MMS text messaging.  As a member of The Tati List (the "Club"), you agree to abide by our Terms of Service, Terms and Conditions, and Privacy Policy. Choosing to Opt-in to our Club implies your acceptance and agreement to the following terms and conditions, including, without limitation, your agreement to resolve any disputes with us in arbitration, as described in our Terms of Service.

To join our Club either opt in via our online sign up form found on the www.TheTatiList.com/Join page or by texting JOIN to 448284 (HITATI).

By joining The Tati List, users are affirming that:

1. They are 18 years of age or older and they are authorized to agree to receive mobile contacts on this phone number and are responsible for any mobile message or data charges incurred.

2. They understand and agree that the text messages may be sent to their mobile phones/devices using an automatic telephone dialing system or other automated means.

3. They consent to receive marketing text messages and understand it is not required as a condition of purchasing any goods or services.

4. They consent to receive email messages.

5. Any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.

YOU AGREE THAT YOU SHALL INDEMNIFY, DEFEND, AND HOLD US HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY US OF A CHANGE IN THE INFORMATION YOU HAVE PROVIDED, INCLUDING ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, et seq., OR SIMILAR STATE AND FEDERAL LAWS, AND ANY REGULATIONS PROMULGATED THEREUNDER RESULTING FROM US ATTEMPTING TO CONTACT YOU AT THE MOBILE TELEPHONE NUMBER YOU PROVIDED.

Authority: You represent to Us that you have the authority to agree to these Terms and perform all of your obligations contained within.

Club Description: Members of the Club can expect to receive marketing and sales messages regarding digital and physical products, services, and events.

Cost and Frequency: Message and data rates may apply.  Message Frequency may vary.

SMS Opt In:  The Club allows users to receive SMS and or MMS by opt in via our online sign up form found on the www.TheTatiList.com/Join page or by texting JOIN to 448284 (HITATI).

Opt Out:  The Club allows users to stop participating and you agree to do so by replying STOP, END, CANCEL, QUIT or UNSUBSCRIBE to 448284 (HITATI) to be removed.

EMAIL Opt In:  The Club allows users to receive EMAIL by opt in via our online sign up form found on the www.TheTatiList.com/Join page.

EMAIL Opt Out:  The Club allows users to stop participating and you agree to do so by clicking Unsubscribe to any email or by email request to support@TheTatiList.com

Support Instructions: We offer support for the Club by texting "HELP" to the number you received messages from or by emailing support@TheTatiList.com. The use of this email address is not acceptable for opting out of the Club. Please follow the above procedures for opting out.

Our Disclaimer of Warranty:  The Club offers no warranty and is offered on an “as-is” basis.  The service may not always be available, and messages may not be delivered due to carrier issues that are beyond our control.  We will not be liable for delays or failures due to undelivered messages.

Participant Requirements:  The user must provide their own mobile device that is capable of two-way texting and maintain a service and data agreement with a cellular provider.  Not all mobile devices are capable, verify with your carrier for your device capabilities and texting instructions.

Age Restriction: The Club prohibits individuals under the age of thirteen (13) from signing up or participating. Individuals aged between thirteen (13) and eighteen (18) require permission from a parent or legal guardian to participate.  You acknowledge and agree that by joining or engaging with the Club you are not under the age of thirteen (13) years, you are between the ages of 13 and eighteen (18) and you have the consent of your parents or legal guardians or are of adult age in your jurisdiction to sign up for or engage with the Club. 

Prohibited Content:  You agree to not send any prohibited content, including anything fraudulent, libelous, defamatory, scandalous, threatening, harassing, profane, obscene, bigoted, or discriminatory on the basis of race, sex, religion, nationality, disability, sexual orientation, or age.  Any other content that is prohibited by Applicable Law in the jurisdiction from which the message is sent is expressly forbidden.

Dispute Resolution:  If a dispute, claim, or controversy arises between You and Us, or any other third-party service provider acting on Our behalf to transmit the mobile messages within the scope of the Club, you agree to the provisions in the Terms of Service regarding dispute resolution and arbitration.

Severability:  If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable.

Modifications: In the event that this Agreement is updated from time to time, you will be notified. You acknowledge that you are responsible for reviewing this Agreement on a regular basis and becoming aware of any such changes. Continuing to participate in the Club after such changes implies that you accept this Agreement, as amended.
